Carrickfergus Trader Fined For Restricting Consumers' Rights
A Carrickfergus motor trader has been fined a total of £200, plus £28 court costs, at Belfast Magistrates Court.
In a case brought by the Trading Standards Service of the Department of Enterprise, Trade and Investment, Trevor Moore Motors Ltd pleaded guilty to two charges under the Consumer Protection from Unfair Trading Regulations 2008.
In August 2010 a consumer bought a used motorcar from the business, but almost immediately discovered a serious oil leak.
Trevor Moore Motors Ltd refused to address the problem, informing the consumer that the car had been "sold as for scrap" as indicated on a receipt and in subsequent written correspondence.
However the consumer had clearly bought the car to be used on the road.
Trading Standards Service spokesperson Declan Brown commented on the case saying that consumer regulations are in place to ensure that consumers' rights are not diminished by the use of restrictive terms.
Mr Brown added: "This retailer attempted to wash his hands of this car and was not prepared to accept any responsibility for what he had sold. The consumer clearly bought the car to use it, rather than for scrap and this was upheld by the court."

Trading Standards officers in Northern Ireland are warning consumers about so-called vehicle matching scams. Vehicle matching scams work by promising to 'match' consumers who are selling their cars, with definite buyers. Typically, the seller is 'cold-called' by telephone, having placed an advertisement in a magazine, website or newspaper.

The Department of Enterprise, Trade and Investment’s Trading Standards Service (TSS) has warned the general public to be wary of counterfeit goods on sale at car boot sales. The TSS made the warning as it advised organisers that it will be visiting car boot sales over the coming months to ensure such goods are not on sale.

Problems with used cars continue to top the number of complaints to Consumerline, new figures released today reveal. Over 1,000 people have complained to Consumerline, the Department of Enterprise, Trade and Investment's consumer advice helpline, about problems with used cars in the last year.
