RESIGNATION DOES NOT MEAN END OF ASSEMBLY
THE resignation of David Trimble as First Minister of the Northern Ireland Assembly does not mean an immediate collapse of the power-sharing executive.
With party colleague Sir Reg Empey fulfilling the duties of First Minister the executive is likely to continue in some form over the next six weeks. On 11 August an election will then be held within the Assembly to appoint a new First Minister and Deputy First Minister.
Although Deputy First Minister Séamus Mallon cannot hold full office without a First Minister in place, the legislation allows him to continue to "exercise the functions of his office until the election" of a new first and deputy first minister.
Nevertheless, if Mr Trimble’s resignation brings the Assembly within the brink of collapse the Secretary of State can opt to suspend the assembly.
His other option would be to call fresh assembly elections if after six weeks no new First Minister is elected.
There is also the possibility that Mr Trimble could be reinstated before the summer recess if he got the necessary support within the Assembly. However, it is highly unlikely that the UUP leader will seek reinstatement if the process of decommissioning has not begun.
