Severely disabled boy wins damages for £3.85m
A boy left severely drain damaged after midwives failed to notice foetal distress during his delivery has been awarded £3.85 million at the High Court.
Lewis Prosser, now seven years old, was left with severe disabilities in October 1997 when he suffered oxygen starvation during the delivery at Princess of Wales Hospital in Bridgend.
Bro Margannwg NHS Trust admitted liability for Lewis's condition. Requiring round-the-clock care, Lewis who suffers from cerebral palsy and is unable to feed himself, walk or talk, visited the court with his parents for the brief hearing today.
Mr Justice Walker approved the settlement figure after he heard legal representation from Bro Margannwg trust offer a public apology for the "failings" that had occurred.
The award for damages is mostly composed of "cost of care" for the lifelong nursing care of Lewis.
The Prosser family said there were "no winners" in this type of battle and that "no amount of money can compensate Lewis for the pain and suffering he had endured".
