The Department of Justice is seeking public views on new proposals to make the creation and sharing of sexually explicit deepfake images of adults a criminal offence. Justice Minister Naomi Long today launched a public consultation as part of ongoing efforts to safeguard the public from the increasing misuse of deepfake technology.

Minister Long stated: "I am proposing to criminalise the increasingly prevalent and despicable behaviours of creating and sharing sexually explicit deepfake images, where somebody’s image is inserted into sexually explicit content without their consent. It is abhorrent behaviour which can have devastating consequences for those whose identities are misused, the overwhelming majority of whom are women." The Minister highlighted the profound impact on victims, who report feeling "embarrassed, humiliated, violated and unsafe," and can suffer from anxiety, post-traumatic stress disorder, with some even considering suicide. "In short, this is an issue which can ruin lives, which is why we are proposing to criminalise the creation and sharing of sexually explicit deepfake images," she added.

The consultation will delve into various factors, including the motivation behind such acts, whether the proposed offence should be dealt with in the Crown or Magistrates Court, and the appropriate sentences for those convicted.

Minister Long further explained that these new offences would augment existing measures designed to protect individuals from sexually motivated behaviours and to eradicate violence against women and girls. She noted her introduction of offences in 2022 to address downblousing, upskirting, and cyberflashing.

"Sexually explicit deepfake images are another form of sexual abuse and exploitation," Minister Long continued. "I will continue to react and respond to enhance legislation relating to those who misuse developments in technology in such a way."
